This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 173/2015 registered at Police Station- Pamgarh District - Janjgir Champa (C.G.) for the offence punishable under Sections 489(b) (c) of IPC. 2.
As per the prosecution case, a complaint was made by the complainant Arun Kumar that the co-accused came to his shop and purchase a CFL bulb and gave a currency note of 1000 rupee to the complainant. Subsequently, on a suspicion of fake currency note, the complainant and the other persons caught Ajit Sahu and Sanjay Sahu. Thereafter, the matter was investigated and on the memorandum statement of coaccused persons 20 fake currency note was recovered from the possession of the applicant.

Counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case and the name of the present
applicant does not find in the FIR and he is in jail since 29.06.2015 and therefore, prays he may be enlarged on bail.

I have gone through the case diary. On perusal of the case diary it purports that from the possession of this applicant 20 fake currency notes were recovered and considering the gravity of offence and manner in which offence was committed. Considering all these facts and the document on record, I am not inclined to release the applicant on bail.
