1. This is an application filed under section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant in connection with Crime No 223 of 2015 registered at Police station Katghora, Distt. Korba (C.G) for the offences punishable under sections 354 of IPC and Sections 7, 8 of Protection of Children from Sexual Offences Act, 2012.

2. As per the prosecution case, the applicant tried to take photographs of the victim girl by Mobile and used filthy language through Mobile which was opposed by the prosecutrix, on which, the applicant caught hold of her hand.

3. Learned counsel for the applicant submits that the prosecutrix and the applicant were fell in love with each other and out of such intimacy/relation, he tried to take photographs of prosecutrix by mobile and no overt act was made. He placed some letters allegedly written by the girl to the applicant. He further submits that the applicant is in jail since 16.09.2015 and prays for releasing him on bail.

4. Per contra, learned State Counsel opposes the prayer for grant of

bail.

5. Having regard to the fact that the applicant is in jail since 16.09.2015 and considering his age and nature of allegations and further taking in fact that the charge sheet has been filed, I am inclined to release the applicant on bail.

6. Accordingly the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court. He shall appear before the trial Court as and when directed by the said Court.
