The applicant is arrested in connection with Crime No. 56/2019 registered in Police Station Pachpedi, District Bilaspur (C.G.) for alleged commission of offence under Section 302 of the Indian Penal Code.

Case of the prosecution is that the applicant assaulted one Tribhuvan Tandan due to which he died.

Learned counsel for the applicant would submit that the applicant has been falsely implicated. All prosecution witnesses including eyewitnesses have been examined. He would submit that testimony of Prashant Tandan (PW5) who has been examined as an eye-witness is highly doubtful as it suffers from various number of discrepancies in view of what has been stated by him in the cross-examination.

Without commenting on merit of case, considering the gravity of allegations, I am not inclined to release the applicant on bail. 5.
