(2) The applicant's first bail application was dismissed for want of prosecution by order of this Court dated 10.02.2015 passed in M.Cr.C. No. 6419/2014.
(3) The applicant's second bail application was also dismissed on merits by order dated 18.03.2015 passed in M.Cr.C. No. 1201/2015 . (4) The accused/applicant has moved this third bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 44/2014 registered at Police Station Bilha, District-Bilaspur for the offence punishable under Section 376/34 of the Indian Penal Code. (5) Counsel for the applicant submits that the Investigating Officcer is not turning up for his examination before the trial Court.
(6) Having heard learned counsel for the parties, having regard to the facts and circumstances of the case, I do not find any new or good ground to entertain this third bail application, therefore, this third bail application is rejected. However, Superintendent of Police is directed to ensure the presence of concerned Investigating Officer before the trial Court for his examination at the earliest.
