Counsel appearing for the respondent submits that pending the application before this Court, the applicant herein has already given undertaking giving his right under Section 12(5) of The Arbitration and Reconciliation Act and in the process the respondent Railway Department appointed an arbitrator and before whom the petitioner has already participated. Given the facts, application as such has become infructuous. Arbitration Application thus stands dismissed as having become infructuous.
