The applicant has preferred this first bail application under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.275/2021 registered at Police Station Bhatapar City- District-District (Revenue & Civil), BalodabazarBhatapara (CG) for the offence punishable under Section 34(2) of the Excise Act.

3. Learned counsel for the applicant seeks permission of the Court to withdraw the bail application with liberty to file afresh if the trial is not concluded within two months.
