1. Heard.

2. The applicant has preferred the second bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.32/2019, registered at Police Station - Benoor, District - Narayanpur (C.G.) for the offence punishable under Sections 341, 435, 392, 34 of the Indian Penal Code.

3. The first bail application of the applicant arising out of present crime number was dismissed on 19-11-2020 alongwith three other crime numbers in which the present applicant is also involved. The present bail application was admitted for hearing because the applicant is in jail since 27-09-2019.

4. The applicant alongwith other accused persons have stopped the bus on highway and committed loot from the passengers and thereafter, poured petrol and torched the bus.

5. Learned State counsel would oppose the prayer for grant of bail.

6. All the offences registered against the applicant are triable by Judicial Magistrate First Class (J.M.F.C.). He is in jail since 27-09-2019 i.e. for about two years, therefore, considering the length of pre-trial detention, I am inclined to release the applicant on bail.

7. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one local surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
