Mr. Bharat Rajput, learned counsel for the petitioner, would submit that the petitioner was suspended vide order dated 07.08.2007 (Annexure-P/2) passed by the respondent No.1 and vide order dated 25.09.2009 (Annexure-P/4) passed by the respondent No.1 itself, the petitioner was reinstated in service, but no subsistence allowances has been paid to the petitioner for the suspension period and instead the said period has been treated as 'awaitnik awakash'.

Mr. Sunil Otwani, learned State counsel, would submit that according to the return filed by the State on 11.02.2014, the amount of Rs.77,015/- has already been paid to the petitioner on 31.01.2014 vide letter dated 03.02.2014 (Annexure-R/1) issued by the respondent No.4 to the respondent No.5, as such no cause of action survives for consideration.

Be that as it may, the petitioner is at liberty to make a representation to the respondent authorities raising the remaining

grievance, if any. On such representation being made within 2 weeks from today, the respondent authorities are directed to consider and decide the petitioner's representation within next 4 weeks.

With the aforesaid observation and direction, the writ petition stands disposed of. No order as to cost (s).
