Shri Deepak Jain, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 21/06/2017 The contempt petition has been filed by the petitioner alleging that though this Court had protected the petitioner by an interim order that no coercive steps shall be taken against the petitioner, the respondents are not allowing the petitioner to work, which amounts to contempt. In the reply, it is stated that even prior to issuance of interim order by this Court, the petitioner was relieved on 07/01/2017 and thereafter, no coercive steps have been taken against the petitioner on account of non-joining at the present place.

Though learned counsel for the petitioner disputes that he was not relieved on 07/01/2017 or that it was an ex-parte relieving order, in my considered opinion, in the facts and circumstances of the case, contempt is not made out. The writ petition is still pending consideration where the issue of relieving or nonrelieving on 07/01/2017 may be raised for consideration.
