The applicant has preferred these first bail applications under
Section 439 of the Code of Criminal Procedure for grant of bail as he is arrested on 18.06.2020 in connection with Crime Nos. 240/2020 and 236/2020, registered in Police Station Kawardha Distt. Kabirdham (C.G.) for offence punishable under sections 420 of IPC and 420, 34 of IPC respectively.

As per the prosecution case, in order to provide an employment in the Police Department, the applicant who runs a Computer Center in the name of Maa Danteswari Choice Centre obtained an amount from the different persons to the extent of more than Rs. 23 Crores. 4.
Learned counsel for the applicant submits that the applicant is in jail since 18.06.2020, all the documents have been collected, chargesheet has been filed and no further investigation is necessary. He also submits that one of the co-accused namely Sheetal Tandan has been enlarged on anticipatory bail by the Co-ordinate Bench, therefore the applicant may also be enlarged on bail.

Learned State counsel opposes the argument made by learned counsel for the applicant.

Perused the case diary, documents and taking into the facts that the applicant is in jail since 18.06.2020, chargesheet has been filed and also considering the fact that the co-accused has also been enlarged on bail, I am inclined to release the applicant on bail. Accordingly, the bail applications are allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- each with one surety in the like sum to the satisfaction of concerned trial court
for his regular appearance before it as and when directed. 7.
