1. The applicant has preferred this application u/s 439 of Cr.P.C. for grant of bail as he is arrested on 02.06.2020 in connection with Crime No. 158/2020 registered at Police Station Kondagaon District Kondagaon for offence punishable under sections 302 of IPC.
2. As per the prosecution case on 02.06.2020 over a dispute the applicant along with other co-accused have committed murder of one Sukuram Baghe.
3. Learned counsel for the applicant would submit that there are three eye witness and all are family members of the deceased, therefore they are interested witness, therefore, the applicant may be enlarged on bail.
4. Learned State counsel opposes the prayer for grant of bail.
5. Considering the fact that three eye witness are present in this case, at this stage whether they are interested witness or not cannot be
said unless and until they are examined before the concerned trial court, therefore, I am not inclined to grant bail.
