Miss. Ranjana Dutta, Public Prosecutor is present in person. She submits that copy was applied, however it could not be procured, therefore communication was made which was not intentional.

Documents also placed. Submission made it appears to be reasonable which is accepted. Copy of statement under Section 164 of Cr.P.C. is placed before this court.

Now presence of Miss. Ranjana Dutta, Public Prosecutor is dispensed with.

Heard.

Learned counsel for the applicant seeks permission of the court to withdraw the bail application with liberty to move again after examination of the prosecutrix.

Prayer allowed.

Accordingly, the bail application is dismissed as withdrawn with liberty aforesaid.
