2. These are the two applications filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No.131/2020 registered at Police Station Kharora, Civil and
MCRC No. 6286 of 2020 and another Revenue District Raipur (CG) for the offence punishable under Sections 420, 406/34 of the IPC and Sections 4 & 6 of the Prize Chits and Money Circulation Schemes Act and Section 10 of the Chhattisgarh Nikshaepakon Ke Hiton Ka Sarankshan Adhiniyam, 2005.
3. The applicants along with other co-accused obtained deposit of Rs.48,05,980/- from different persons on assurance of doubling the amount within 15 days, but thereafter, even the original amount was not paid.
4. Learned counsel for the applicants would submit that the applicants are agents and have themselves deposited Rs. 15 lakhs with the company. He would submit that the amount has been obtained by the other accused persons and not by these applicants.
5. Learned counsel for the State would submit that similarly placed co-accused Poshan Dewangan has been refused bail by this Court in MCRC No.4834 of 2020 vide order dated 17.9.2020.
6. Considering the order passed by this Court in MCRC No.4834 of 2020 and having perused the case diary, the case of the present applicants appears to be similar to that of co-accused Poshan Dewangan, therefore, no case for grant of bail is made out.
