1. The Challenge in the present Writ Petition is the order dated 01.10.2016 passed by the Respondent No.3 whereby the Petitioner has been inflicted with a punishment of reduction to one stage lower for one year without cumulative effect.

2. The record shows that the Petitioner has already preferred an appeal against the said order under Clause 36 of the Conduct, Discipline and Appeal Rules, 1978 of Coal India Limited.

3. Further the record also shows that the appeal is pending consideration before the Appellate Authority. This Court is not

inclined to entertain the present Writ Petition and it is being disposed off with a direction to the Appellate Authority to take a decision on the appeal preferred by the present Petitioner preferably within a period of 3 months from the date of presentation of this order before the Appellate Authority.

4. With the aforesaid observation the present Writ Petition stands disposed off.
