The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 221/2015 registered in Police Station Balco Nagar, Korba District Korba (C.G.) for offence punishable under section 379 r/w section 34 of IPC.

As per the prosecution case on 3/09/2015 applicant was driving auto in which aluminium scrap were being carried which was stolen from the BALCO worth Rs.10,000/- along with him another co-accused Shyam Sunder Gupta was also present. Auto having been intercepted commission of the theft came to light.

Learned counsel for the applicant submits that applicant has been falsely implicated in this case. He was only driver of the vehicle and he had no knowledge about the goods stolen. He further submits that charge

sheet has been filed and applicant is in jail since 3/09/2015, therefore applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Taking into consideration facts and circumstances of the case and further taking into consideration the manner in which offence has been committed, charge sheet has been filed and also considering the pre-trial detention, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
