1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 28.12.2019 in connection with Crime No.599/2020 for the offence punishable under Section 302 of IPC, registered at Police Station- Kota, Bilaspur, DistrictBilaspur (C.G.).
2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file afresh as and when occasion arises.
3) Counsel for the State has no objection to the above prayer.
4) Permission granted.
5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
6) Registry is directed to return the certified copy of the depositions of the prosecution witnesses to the counsel for the applicant on his furnishing true authenticated photocopy of the same.
