Hon'ble Justice Shri Gautam Chourdiya Order on Board 30/11/2021 1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 06/08/2021 in connection with Crime No. 346/2020 registered at Police Station Seepat, District Bilaspur (C.G.) for the offence punishable under Sections 354 & 506 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.

2) At the outset, learned Counsel appearing for the State submits that apart from the present Crime Number, the applicant has 02 criminal antecedents of similar nature.

3) In view of above, learned Counsel for the applicant seeks to withdraw this bail application with liberty to file afresh as and when occasion arises.

4) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
