1. This appeal is arising out of the judgment of conviction and order of sentence dated 05.09.2020 passed by the Special Judge, (N.D.P.S. Act), Bilaspur, District Bilaspur (C.G.) in Special (N.D.P.S.) Case No. 39/2017, whereby the Appellant stands convicted and sentenced as under:- Conviction Sentence Under Section 20 (B) (ii-c) of N.D.P.S. Act 1985) R.I. for ten years and pay a fine of Rs.1,00,000/-, in default of payment to further undergo R.I. for six months

2. Previously appeal i.e. Cr.A. No. 682 of 2020 was filed by the appellants namely Rajesh Asthana & Shiva Bodonayak against the same judgment of conviction and order of sentence dated 05.09.2020.

3. In view of the above, learned counsel for the appellant seeks to withdraw this appeal (Cr.A. No. 822 of 2020).
