1. The grievance of the petitioner is that respondent No. 5 namely Ishwar Kumar Sahu has filed an appeal under section 44 (2) of the Land Revenue Code, 1959 which is pending before the Commissioner, Durg which would be evident from Annexure P-5 and one year has passed, however the proceedings have not been commenced, therefore, he prays that Commissioner, Durg may be directed to decide the appeal filed by Respondent No. 5 within stipulated time.

3. Without any observation on the merits, it is directed that the Commissioner, Durg shall decide the appeal filed by Respondent No. 5 within outer limit of 90 days from the date of receipt of a copy of this order.
