This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.27/2016 registered at Police Station- Benoor, Revenue District- Narayanpur, Civil District- Kondagaon (C.G.) for the offence punishable under Section 374 of Indian Penal Code and Section 75 of Juvenile Justice (Care & Protection of Children) Act, 2015. 2.

As per the prosecution case, a report was made on 10.08.2016 that the applicant who is the Hostel Superintendent on 08.08.2016 took 4-5 girls to her village and forced them to work in the field and it was continued for two days and also two of the girl were taken to her house and they were forced to work as domestic help; thereby the offence is committed.

Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case and she is in jail since 11.08.2016, therefore, the applicant may be released on bail. 4.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the statement. Considering the facts and circumstances of the case, nature of offence and degree of allegation and the fact that the applicant is a lady, aged about 50 years, and she is in jail since 11.08.2016, I am inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on her furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for her appearance as and when directed. Sd/- (Goutam Bhaduri) Judge Ashok
