2. Learned counsel for the petitioner submits that the father of the petitioner Late Shri Ramsharan Sahu, who was working as Assistant Grade II (UDC) at Dr. Bhim Rao Ambedkar Govt. College Pamgarh District Janjgir- Champa(C.G.), died in harness on 30.12.2018,

therefore, the petitioner being the son and dependent, filed an application to the respondent authorities on 16.01.2019 (Annexure P/2) so that his case for compassionate appointment may be considered. It is further submitted that the said application was forwarded by the Principal, Dr. Bhim Rao Ambedkar Govt. College (respondent No. 5) to the Commissioner, Directorate of Higher Education (respondent No. 2) by Annexure P/4 on 16.01.2019, however, the same is still pending consideration and no decision has been arrived at. Therefore, the limited prayer of the petitioner at present is that his application for compassionate appointment may be decided within a stipulated time.

3. Learned State counsel submits that the application of the petitioner for compassionate appointment would be decided.

4. Perused the documents. Perusal of the documents shows that the father of the petitioner late Shri Ramsharan Sahu died in harness on 30.12.2018 and thereafter the petitioner had filed an application for compassionate appointment on 16.01.2019, the same was forwarded by the Principal of Dr. Bhim Rao Ambedkar Govt. College i.e. respondent No. 5 (wherein the deceased was working as Assistant Grade II). The said communication was made vide letter dated 16.01.2019 (Annexure P/4) to the Commissioner, Directorate of Higher Education (respondent No. 2).

5. Considering the facts of the case, as considerable time has rolled by, it is directed that the Commissioner, Directorate of Higher Education i.e. respondent No. 2 shall decide the application of the petitioner for compassionate appointment, according to the prevailing rules for

compassionate appointment, within a period of 90 days from the date of receipt of copy of this order.

6. With the aforesaid direction/ observation, the present writ petition stands disposed off.
