This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.247/2015 registered at Police Station- Nevai, District Durg (C.G.) for the offence punishable under Sections 186, 353, 332, 333, 294, 506B, 147, 148, 149 of Indian Penal Code. 2.

As per the prosecution case, in brief, on 05.10.2015 an FIR was registered against one Akhilesh Yadav and others that they entered in front of the Police Station and manhandled one Sub Inspector who oppose the altercation started in between the two groups.

Learned counsel for the applicant submits that total 18 accused have been arrayed in the crime and the applicant has been falsely implicated though he was only spectator to the crime. He further submits that the charge sheet has been filed and the offence is

triable by JMFC and considering the detention of the applicant, he may be enlarged on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

I have heard learned counsel appearing for the parties and perused the case diary.

Having regard to the facts and circumstances of the case and taking into consideration the nature and gravity of offence and further taking into fact that the applicant is in jail since 20.10.2015, I am inclined to release the applicant on bail. 7.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed. 9.
