This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No.195 of 2015, registered at Police Station Navai, District Durg (C.G.) for offence punishable under Section 307/34 of IPC.

According to the case of prosecution on 26/07/2015 applicant along with other persons armed with sword, rod, club and hockey stick attacked one Ahmed Nadim Khan due to the earlier dispute. 3.

Learned counsel for the applicant submits that this applicant has not been named by the injured Ahmed Nadim Khan and therefore he has been falsely implicated in the case and it is out come of the cable war, therefore applicant may be granted benefit of anticipatory bail. 4.

Learned State counsel opposes the prayer for grant of anticipatory bail and submits that according to the statement of Shamshul Khan who is eye witness this applicant has been named.

I have gone through the case diary and perused the statement of eye witness Shamshul Khan who has named this applicant, therefore I am

not inclined to extend benefit of anticipatory bail to the applicant. 6.

Accordingly, the anticipatory bail application is dismissed. Certified copy as per rules.
