Hon'ble Shri Justice Gautam Chourdiya Order on Board 25/10/2021 1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 09/06/2021 in connection with Crime No. 176/2021 registered at Police Station Tilda Nevra, District Raipur (C.G.) for the offence punishable under Sections 363, 366, 376 of the Indian Penal Code and Section 4 & 6 of the Protection of Children from Sexual Offences (POCSO) Act, 2012.

2) Learned counsel for the applicant seeks to withdraw this bail application with liberty to file afresh as and when occasion arises.

3) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
