This is the second bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.35/2015, registered at Police Station Nevra District Raipur (C.G.), for the offence punishable under Sections 201, 302 & 34 of the IPC.

The applicant's first bail application was dismissed as withdrawn vide order dated 16/06/2015 in M.Cr.C. No.2450/2015. 3.

Case of the prosecution, in brief, is that, on 15/01/2015, applicant along and co-accused persons with the common intention murdered Kunti Parthi by strangulation and thereby committed aforesaid offence. 4.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; further taking into

consideration the nature and gravity of offence; the manner, in which, deceased was strangulated and her dead body was concealed by the applicant and other co-accused persons, this Court is not inclined to release the applicant on regular bail.

Accordingly, second bail application filed under Section 439 of the Cr.P.C. is rejected.
