Instant petition was filed while the Rent Control Appellate Tribunal was not working. Presently it has been stated that the Rent Control Appellate Tribunal has been constituted which is functional, therefore since the order under challenge is by the Rent Control Authority which is appealable before the Rent Control Appellate Tribunal, the petitioner may prefer an appeal before the Rent Control Appellate Tribunal within a period of two weeks. The petitioner is also at liberty to file an application for stay of the order. The Appellate Authority Rent Control Tribunal shall be obliged to hear the case on interim stay within a further period of four weeks from the date of filing of the appeal. Since interim protection was granted to the petitioner vide order dated 12/10/2020, it is ordered that till the interim application is decided, the order dated 5/09/2020 shall not be given effect to. 2.
