Learned counsel for the petitioner submits that show cause notice under Section 40(1) of the Panchayat Raj Adhiniyam, 1993 has been issued to the petitioner / Sarpanch on 01.06.2018 (Annexure - P/4) against which petitioner has already filed reply but it has not been considered and decided till date. 2.

I have heard learned counsel for the petitioner. 3.

Be that as it may, the Sub-Divisional Officer (Revenue) is directed to consider the reply filed by the petitioner / Sarpanch and thereafter, take a decision on the same strictly in accordance with law, expeditiously. 4.

It is made clear that this Court has not expressed any opinion on the merits of the matter. It is for the authority to consider and decide the petitioner's reply strictly in accordance with law.

With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
