1. Heard.

2. Learned counsel for the petitioner submits that the petitioner was in possession of a land bearing Khasra No.1106/1, admeasuring 3500 sq ft. for the last many years which was a government land, since the proceedings for ejectment were carried out certain fine was imposed which was deposited. He would further submit that during such pendency of the proceedings earlier also the petitioner had filed an application for allotment of the said land on lease, wherein no objection from the different departments were also furnished in favour of the

petitioner, however, despite that during pendency of such application to grant lease, in the meanwhile without consideration that application to grant lease is pending coupled with no objection of different government department are given in favour of the petitioner, the Tehsildar has removed the construction. Therefore, the prayer is made that the application for grant of lease to the petitioner may be directed to be decided within a time frame.

3. Perused the respective documents.

4. The application of the petitioner for grant of lease was under consideration by the State. The documents would further show that no objection by the different departments were on record as the publication was made inviting objections and no objection was received. In the meanwhile, the petitioner has been disposesed. Be that as it may, since the application of the petitioner for grant of lease is pending adjudication before the Tehsildar, Kondagaon in revenue case No.A-20(1)/2015-16 which is filed as Annexure P-4, the concerned Tehsildar is directed to decide the grant of lease to the petitioner within a further period of four weeks from the date of receipt of copy of this order taking into consideration the documents so placed on record by the petitioner.
