Hon'ble Shri Justice Manindra Mohan Shrivastava Hon'ble Smt. Justice Vimla Singh Kapoor, Order on Board by Justice Manindra Mohan Shrivastava, J. 15.03.2021 Heard on application for condonation of delay as well as prayer for grant of leave to appeal.
Even if, we are inclined to condone the delay there is no merit in the application because the evidence of the prosecutrix as has been appreciated by the trial Court, is that prior to lodging of report in the present case, the prosecutrix claim to be the wife of the accused and lodged report of cruelty in connection with demand of dowry and stated regarding solemnization of marriage between them and later on the allegation of rape stating that the prosecutrix did not accept the marriage was lodged.
Accordingly, CRMP is dismissed.4.
