Challenge in the present writ petition is to the order dated 28.7.2017 (Annexure P-1) whereby the service of the Petitioner has been transferred from the Community Health Centre, Gurur, District Balod to Community Health Centre, Manpur, District Rajnandgaon.

At the outset, this Court is not inclined to entertain the present writ petition, on the simple ground that the present writ petition has been filed on 17.3.2017 whereas the order of transfer was issued almost about 9 months back.

At this juncture, Counsel for the Petitioner submits that on account of health condition of the Petitioner and also the fact that his wife is also employed with the State Government, he has already made a representation to the higher authorities in the department and who, in turn, have forwarded the same to the Committee constituted for scrutinising the representations. The said representation has not been decided till date. 4.
Without entering into the merits of the case, the present writ petition is disposed of, observing that the Respondents may consider the representation of the Petitioner and shall decide the same if not decided till now.
-2It is expected that a decision shall be taken by the competent authority at the earliest.

The writ petition stands accordingly finally disposed of. No order as to costs.
