This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No.910 of 2015, registered at Police Station Supela, Bhilai, District Durg (C.G.) for offence punishable under Section 420 of IPC.

According to the case of prosecution an application having been filed under Section 156(3) of Cr.P.C. by the complainant Ramprasad Sinha against the present applicant investigation was made. It is case of the prosecution applicant showing himself to be agent of Real Goat Farming India Pvt. Ltd. assured different persons to deposit amount in the company so as to get double the amount and loan on that amount. Consequently, amount of Rs.2,37,900/- was deposited and Rs.4,57,500/- maturity amount received was used by the applicant. Subsequently, when some people asked for the loan it was stated that loan would be available after five years. On being return having been claimed same was not made. Therefore, matter is being investigated.

Learned counsel for the applicant submits that applicant himself has deposited amount in the company and on the report of the applicant case has been registered against Real Goat Farming India Pvt. Ltd. and its directors, therefore the applicant has not committed any offence, he may be granted benefit of anticipatory bail.

Learned State counsel opposes the prayer for grant of anticipatory bail.

I have gone through the case diary and the statement and the documents, matter needs investigation. Applicant even if have made deposits it will not exonerate him and considering the nature of the allegations custodial interrogation may be required. Therefore, I am not inclined to extend benefit of anticipatory bail to the applicant. 6.
Accordingly, the anticipatory bail application is dismissed. Certified copy as per rules.
