The applicant has preferred this first bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.27/2018, registered at Police Station Ramanujganj, District Balrampur-Ramanujganj (CG), for the offence under Section 409 read with Section 34 of the Indian Penal Code.

Applicant along with co-accused Mohd. Manjar Ansari has committed misappropriation of 2268 bags of paddy valued at Rs.14,42,130/- while working in the Adim Jati Sewa Sahakari Sanstha, Bhanwarmal, District Balrampur-Ramanujganj. The incident happened in the paddy procurement season of 2017-18. The offence was registered in 2018 itself, however, the applicant has been arrested on 6-8-2020.

Considering the facts situation of the case, particularly considering the fact that the offence is triable by the JMFC; the applicant has already been retired from service on attaining the age of superannuation from the Primary Credit Cooperative Society; and the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
