Hon'ble Justice Shri Gautam Chourdiya Order on Board 21/01/2021 1) This appeal by the accused/appellant under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 is directed against the order dated 13/07/2020 passed by the Special Sesions Judge (Atrocities), Balodabazar, District Balodabazar - Bhatapara (C.G.) in Special Case No. (POCSO) 561/2020, refusing to allow his regular bail under Section 439 Cr.P.C. The appellant is in jail since 05/07/2020 in connection with Crime No. 119/2020 for the offence punishable under Sections 376, 506, 34 of IPC, under Section 6 of POCSO Act and under Section 3 (2)(v)(a) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 registered at Police Station Suhela, District Balodabazar - Bhatapara (C.G.).

2) At the very outset, learned counsel appearing for the appellant seeks to withdraw this appeal with liberty to file afresh appeal at the appropriate stage.

3) Prosecutrix present in person today and raised objection to release of the appellant on bail.

4) Accordingly, the appeal is dismissed as withdrawn with the liberty as stated above.
