The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 188/2015 registered in Police Station Pandariya, District Kabirdham (C.G.) for offence punishable under section 20 (B) of N.D.P.S. Act.

As per the prosecution case on information received that the applicant was travelling with another co-accused in motorcycle, motorcycle having been intercepted from the possession of the applicant 4.900 gms of cannabis were recovered.

Learned counsel for the applicant submits that applicant has not committed any offence, he was only pillion rider and motorcycle was driven by Balram other co-accused. He was not in conscious possession of the cannabis, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

I have perused the case diary. Perusal of the same prima facie it appears that applicant along with co-accused was apprehended with the

cannabis, considering the primary evidence available and the quantity of cannabis recovered, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
