2. The petitioner has preferred this writ petition seeking the relief to direct respondent authorities to fix his pay scale from Rs.2800/- to Rs. 4200/-.

3. The petitioner is working as Constable (Driver) and posted at 7th Battalion, Bhilai, District Durg.

4. Counsel for the petitioner would submit that the petitioner may be permitted to file fresh representation before respondent No.4 for

redressal of his grievances and the instant writ petition may be disposed of by giving direction to respondent No.4 to decide such representation within stipulated time.

5. Looking to the facts and circumstances of the case and submission made by counsel for the petitioner, the instant writ petition is disposed of with this direction that the petitioner may file fresh representation before respondent No.4 for redressal of his grievances within 10 days from today. If such representation is filed by the petitioner before respondent No.4, then respondent No.4 shall decide such representation within a period of 90 days from the date of receipt of such representation in accordance with law.

6. It is made clear that this Court has not expressed any opinion on the merits of the case.
