Learned counsel for the petitioner submits that despite order of this Court, instead of deciding himself the Collector has sent the representation of the petitioner to the State Government for being considered by the Committee constituted for decision of the representations against transfer.

The said transfer policy dated 11.06.2016 requires consideration of representation by the State Government. This Court has directed the Collector to consider the representation, however, the Collector in view of procedure prescribed in the policy has forwarded the matter for consideration to the Committee.

Even though, this Court has directed the Collector to consider the representation, reasons assigned in memo dated 01.09.2016 does not show that the Collector has flouted the order passed by this Court, therefore, I am not inclined to initiate any contempt proceeding. However, in view of memo dated 01.09.2016, it will be proper to direct State Government to pass appropriate order in the case of the petitioner within a period of four weeks from the date of receipt of a copy of this order.

The petition is accordingly disposed off.
