1. Heard.

2. This is the fifth application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.16/2020 registered at Police Station Shyang, District Korba (CG) for the offence punishable under Sections 420, 467, 468, 471 r/w Section 120-B, 34 of the IPC.

3. The earlier bail applications were dismissed on merits, however, co-accused Moh. Akram Siddiqi has been allowed anticipatory bail in MCRCA No.350/2021.

4. The applicant along with co-accused Moh. Akram Siddiqi and

MCRC No. 6814 of 2021 others have sold Government land bearing Khasra No.343/1 and 349 admeasuring 2.189 hectare and 0.955 hectare respectively at Village Chiraa and Khasra No.175 admeasuring 1.011 hectare situated at village Solwa without obtaining permission from the concerned Collector and hacking the login ID of Halka Patwari for making on-line correction in the records in the Bhuiya Software of the Revenue Department of the Government.

5. Learned State Counsel would oppose the prayer for grant of bail.

The applicant is in jail since 1.10.2020 i.e. for about a year; he has already been released on bail in other similar offences of other crime numbers; and in all the cases, the offences are triable by the Judicial Magistrate First Class, therefore, considering the length of pre-trial detention, I am inclined to release the applicant on regular bail.

7. Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
