NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Writ Petition (S) No.5334 of 2016 Subhash Prasad Sinha, S/o Raghunandan Prasad Sinha, aged about 47 years, R/o Mukti Para, Atal Awas, House No.K-1, Gandhi Nagar, Tah. Ambikapur, Distt. Ambikapur-Sarguja (C.G.) ---- Petitioner

Versus

1. State of Chhattisgarh, through the Secretary, Department of Water Resources, Bhawan Mantralay, Thana Naya Raipur, Tah. & Distt. Raipur (C.G.)

2. Sub-Divisional Officer, Water Resources Department, SubDivision No.2, Thana Ambikapur & Distt. Ambikapur-Sarguja (C.G.) ---- Respondents For Petitioner:

Mr. N.K. Malaviya, Advocate.

For Respondents/State: Mr. Ashish Surana, Panel Lawyer. Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 19/10/2016

1. This Court on 4-2-2015 had directed to decide the representation of the petitioner. It appears that the petitioner's representation is pending and again, second writ petition has been filed which is not maintainable. If the earlier order dated 4-2-2015 passed in favour of the petitioner in W.P.(S) No.1469/2005 has not been complied with, the petitioner may take recourse to the proceeding available under the law, but certainly cannot maintain this writ petition.

2. Accordingly, this writ petition is dismissed in limine. However, this order will not bar the petitioner to invoke the remedy available under the law.
