NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 1489 of 2017 • Ramnarayan Rajput S/o. Late Baisakhu Ram Rajput, Aged About 43 Years, Working Constable C.I.S.F., R/o Village And Post Baera, P. S. Patharia, District Mungeli, Chhattisgarh. ---- Petitioner

Versus

1. Union Of India Through Director General, Central Industrial Security Force (Ministry Of Home Affairs) B-4 Wing, 4th Floor, PT. Deendaya Antyodaya Bhawan, 16 CGO Complex, Lodhi Road New Delhi- 110003

2. Additional Director General (Estt. Il), Central Industrial Security Force (Ministry Of Home Affairs) B-4 Wing, 4th Floor, PT. Deendaya Antyodaya Bhawan, 16 CGO Complex, Lodhi Road, New Delhi 110003

3. Additional Director General (R&S) Central Industrial Security Force (Ministry Of Home Affairs) B-4 Wing, 4th Floor, PT. Deendaya Antyodaya Bhawan, 16 CGO Complex, Lodhi Road, New Delhi 110003 ---- Respondents For Petitioner Shri Akhilesh Mishra, Advocate For Respondent No.1 Shri R. K. Gupta, Standing counsel Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 28/03/2017 1.

The petitioner is a constable in the Central Industrial Security Force (CISF) and is presently posted at Raipur. By the impugned order, he has been transferred to New Delhi. 2.

It is argued that the petitioner was earlier posted at Ahmedabad, where from he was transferred to Raipur on

03.08.2015 on his own request. Thus, he has hardly completed little more than one and half years, which is less than the normal tenure at a station as per the Guidelines, yet the petitioner has been transferred before completion of the tenure.

3.

It appears, the petitioner has preferred representation before the respondents mentioning his personal difficulties. Under Clause 10 (A) of the Guidelines governing the transfer/posting of the constables of CISF, the final authority to consider prayer for posting and transfer is the Director General of CISF. Since, this Court is not entitled to interfere in the matters of transfer and posting, wherein an accommodation is sought only on personal grounds, let the petitioner move a fresh representation before the Director General, CISF within 15 days from today and thereafter the said Authority shall decide the petitioner's representation within next 6 weeks. 4.

Till the petitioner's representation is decided, he shall be allowed to continue at Raipur.

5.

The writ petition stands disposed of.
