Hon'ble Shri Justice P. Sam Koshy Order on Board 07/10/2016 The grievance of the petitioner in the present case is that the respondent corporation though has already considered the case of the petitioner as also the other similarly placed employees who are initially working as a daily wages employee for being regularized their services but till date has not passed any order in this regard. 2.

According to the counsel for the petitioner, the Corporation has already considered the case of the petitioner and has also recommended for being regularized but the respondent authorities are not passing any order in this regard and the petitioner is continuously working as a daily wage worker. Counsel for the petitioner refers to the order of this Court dated 31.08.2016 passed in W.P.(S) 4235 of 2016 whereby the petition of a similarly placed employee has been disposed of with a direction to the

-2respondents to examine and scrutinize the petitioner's record of service and his claim for regularization in terms of circular dated 05.03.2008 of the State Govt. which was passed in the light of the judgment of the Supreme Court in the case of Secretary, State of Karnataka and others Vs. Uma Devi (3) and others, reported in 2006 (4) SCC 1. 3.

Having considered the facts and circumstances of the case and finding the case of the present petitioner to be similar to that of the writ petition (S) No. 4235 of 2016, this Court is inclined to dispose of the present petition in similar terms.

Accordingly, the present petition also stands disposed of in terms of the direction given by this Court in W.P.(S) No. 4235 of 2016 dated 31.08.2016.

It is expected that the respondents shall examine and scrutinize the petitioner's record of service and his claim for regularization in terms of the circular of the State of CG dated 05.03.2008 in respect of the regularization of the daily wages employee and shall take a decision thereon within a period of four months from the date of receipt of copy of this order.
