The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 182/2015 registered in Police Station Pithora, Tahsil and District Mahasamund for offence punishable under section 420/34 of IPC.

As per the prosecution case, one Basant Malti has received an amount of Rs.2.50 lakhs from the complainant Munuram Bariha to get his son employed in Mantralaya.

Learned counsel for the applicant submits that amount was received in presence of this applicant. He submits that only this applicant was present at the time of the transaction and he has introduced the accused Basant Malti to the complainant and actually the amount was received by Basant Malti and no further allegation have been made against this applicant, therefore, the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

I have perused the statement and the complaint. Perusal of the

complaint shows that main allegation of receipt of money is against Basant Malti and it is stated that applicant extended assurance to believe on the statement of Basant Malti. Taking into account degree of allegation against this applicant, charge sheet having been filed and applicant is in jail since 14/10/2015, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
