The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No. 293/2015 registered in Police Station Kurud, District Dhamtari (C.G.) for offence punishable under section 379/34 of Indian Penal Code.

As per the prosecution case complaint was lodged by Kuleshwar Lal Sahu that his mobile has been stolen and subsequently on the investigation police has recovered one mobile each and cash from the possession of these applicants, thereby offence has been committed. 3.

Learned counsel for the applicants submits that the applicants have been falsely implicated in this case and only on the basis of the suspicion they have been implicated. He further submits that charge sheet in this case has been filed and applicants are in jail since 11/08/2015, therefore they may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

Having regard to the facts and circumstances of the case, taking into account nature and degree of allegations made, charge sheet having been filed and the applicants are in jail since 11/08/2015, this court is inclined to release the applicants on bail.

Accordingly, the bail application is allowed and it is directed that the applicants shall be released on each of them furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
