It is brought to the notice of this Court by referring to order dated 10.11.2016 (Annexure R/5) that a decision has already been taken to consider the petitioner's case for promotion as and when vacancy would arise by giving benefit as per circular dated 27.09.2014. It is stated that in the order that presently there is no vacancy and upon availability of vacancy, the case of the petitioner would be considered for promotion as disabled category candidate.

In view of the above, I am not inclined to proceed further in the matter. The Rule is discharged and the contempt petition is closed. Sd/- (Manindra Mohan Shrivastava) Judge Rekha
