Learned counsel for the petitioner seeks to withdraw the petition with the liberty to challenge initiation of the departmental enquiry. 2.

While challenging the transfer order, the petitioner's right to challenge the legality and validity of the departmental enquiry is not abdicated, therefore, withdrawal of the petition shall not come in the way of the petitioner exercising his right to challenge the departmental proceedings as available to him under the law. 3.

Subject to aforesaid clarification, the petition is dismissed as withdrawn.
