Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 16.12.2020

1. This is third bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court. No other bail application is pending before any other Court.

2. Earlier, the first bail application of the applicant was rejected by this Court vide order dated 05.04.2019 passed in MCRC No. 339 of 2019 considering prima facie case against him and his second bail application was rejected by the Registry due to non compliance of order of this Court dated 17.06.2019 passed in MCRC No. 3159 of 2019.

3. Counsel for the applicant submitted that out of 11, 8 prosecution witnesses have been examined, only one Doctor and two investigating officers are to be examined. In these circumstances, he does not want to press this bail petition.

4. He further submitted that the trial Court may be directed to expedite the trial and dispose off the case within stipulated time.

5. The instant petition is rejected as not pressed. However, the trial Court is directed to expedite the trial and dispose off the case as soon as possible preferably within two months from the date of receipt of copy of this order. Sd/- (Sharad Kumar Gupta) JUDGE kishore
