1. Heard.

2. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 17.08.2021 in connection with Crime No. 371/2021 registered at Police Station Urga, District Korba (CG) for the offence punishable under Section 376 of Indian Penal Code and Section 6 Protection of Children from Sexual Offences Act.

3. As per the prosecution case, on 15.08.2021 the victim who is said to be a minor was subjected to sexual intercourse on the pretext of marriage and when she became pregnant, the applicant refused to marry. Thereby the offence has

been committed.

4. The record would show that the victim appeared before this Court on 06.10.2021 through the help desk of DLSA Korba and has not objected the grant of bail to the applicant.

5. Having considered the age of the prosecutrix and the background of the case and no objection made by the prosecutrix before this Court, I am inclined to release the applicant on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court.
