1. Heard.

2. On due consideration delay of 181 days in filing of

CRMP No. 1710 of 2019 CRMP is condoned. Accordingly, I.A. No.01 of 2019, application for condonation of delay in filing of the CRMP is allowed.

3. The trial Court has acquitted the accused of the charges under Sections 363, 366, 450 of I.P.C. and in alternative under Section 5(ठ) read with Section 6 of the Protection of Children from Sexual Offences Act, 2012 and under Section 376(2)(ढ) of the I.P.C.

4. The prosecutrix, examined as PW-1 before the trial Court, has turned hostile and has not supported the prosecution at any stage of examination.

5. Considering the statement of prosecutrix and other evidences on record, we are not inclined to grant leave to appeal.

6. In view of the above, the present CRMP deserves to be and is hereby dismissed.
