The appeal is admitted on the following substantial questions of law. "(i). Whether the learned Commissioner is justified in exonerating the Insurance Company from its liability?

(ii). Whether the learned Commissioner is justified in recording a finding that there was breach of policy conditions only on the basis of Ext. D5, D6 and D7 which are the letters from office of Insurance Company?"

With the consent of parties, the appeal is heard finally and order(s) passed separately.
