1. This is an application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 150/2015 registered at P.S. Palari, Distt. Balodabazar-Bhatapara (C.G) for the offence punishable under Section 186 & 353 IPC and Section 140 of Electricity Act.
2. As per the prosecution case, complainant Vinod Kumar Dahariya who is an Assistant Engineer lodged FIR in Electricity Department that on 15.05.2015 at about 9.30 a.m., when the electricity was off, the applicant who disclosed his identify as journalist of Hari Bhumi entered into the office and abused officer and assaulted by hands and fists whereby the complainant sustained injuries. Therefore, on report being made the matter is being investigated.
3. Learned counsel for the applicant submits when the
electricity was off, a mob of 200-300 persons have gone to the electricity office to protest against the power-cut and committed offence and this applicant has been falsely implicates in this case. He further submits that the charge sheet having been filed no further investigation is required. It is also submitted that the applicant is in jail since 30.11.2015, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application.

6. Considering the nature of allegations and the fact that charge sheet has been filed in this case and the applicant is in jail since 30.11.2015, I am inclined to release him on bail.
7. Accordingly the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. He is directed to appear before the said Court as and when directed by the said Court.
