Hon'ble Shri Justice Goutam Bhaduri Order On Board 17/0 4/2017 1.

The instant petition has been filed by the petitioner for the following reliefs :

i.

That, this Hon'ble Court may kindly call for the entire records in relates to the case of the petitioner.

ii. That, this Hon'ble Court may kindly be pleased to issue a writ or

writs/order/ or orders to direct the Tahsildar, Saraipali, District Mahasamund (C.G.) to decide the application under Section 188 of Indian Penal Code (Annexure P/1), within a period of one month, in the interest of justice, and further be directed to the respondent Tahsildar to finally decide the Revenue Case No.192/A/74/2015-16 as earliest possible.

iii. That, any other relief, this Hon'ble Court deem fit and proper may also kindly be granted to the petitioner, in the interest of justice. 2.

Learned counsel for the petitioner is not able to submit what personal right has been infringed whereby the petitioner can file this petition like the nature of the relief.

This Court in exercise of powers under Article 226 of the Constitution of India, cannot monitor the revenue case which is pending before the Tahsildar Saraipali and the petitioner may approach the respective higher officials of Revenue Department.

Considering the prima facie facts of this case, no case is made out to interfere in the revenue case pending before the Tahsildar. 5.

The petition is therefore dismissed.
